Legality of Aesthetic Doctor Practice in Beauty Clinics Analysis Based on the Law on Medical Practice and Health Law

Abstract

In recent years, the trend of beauty services has seen a significant surge, driving the emergence of various beauty clinics offering medical aesthetic procedures. This phenomenon is inseparable from the increasing need for instant and medical-technology-based appearance treatment. However, behind its popularity, the practice of aesthetic doctors in beauty clinics raises legal issues regarding the validity, competence, and limits of medical authority carried out. Moreover, the prevalence of practice by doctors who do not have aesthetic qualifications or by non-medical personnel strengthens the urgency of the study from the aspect of legality. This study aims to analyze the legality of aesthetic doctor practice based on Law Number 17 of 2023 concerning Medical Practice and other provisions in health law. This research also explores the extent to which current regulations provide legal certainty and protection for patients. In addition, this study aims to assess the suitability between practices that occur in the field and the applicable positive legal provisions. The main focus is directed at the administrative and ethical aspects of medicine, including licensing, registration, and certification of competencies in the field of aesthetics. The method used in this study is a normative juridical approach with data collection techniques through literature studies, documentation of laws and regulations, and analysis of academic literature and related legal decisions. This research is descriptive-analytical with the aim of providing an objective picture of the actual condition of medical aesthetic practice in the legal framework in Indonesia.
