Aspects of Criminal Responsibility in Online Gambling Crimes According to Indonesian Law

The development of information technology has had a significant impact on various aspects of life, including the emergence of new forms of crime such as online gambling. Online gambling is a form of crime that utilizes electronic means and the internet network as a medium for its implementation. This study aims to examine the aspects of criminal liability for perpetrators of online gambling crimes according to positive legal provisions in Indonesia. The method used in this study is normative juridical with a statutory approach and a conceptual approach. The results of the study indicate that online gambling crimes can be prosecuted under the provisions of the Criminal Code (KUHP), Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE) as amended by Law Number 19 of 2016, and other relevant laws and regulations. Criminal liability can be imposed on perpetrators individually or corporately, depending on their role and level of involvement in online gambling activities. Although regulations are available, there are still challenges in the aspect of law enforcement, especially regarding the proof and identification of perpetrators in cyberspace. Therefore, it is necessary to strengthen criminal law policies and increase the capacity of law enforcement officers in handling cybercrimes such as online gambling effectively and comprehensively.
