Health Law Study in the Use of Teledentistry For Dentists in Indonesia

Abstract

The current development of digital technology in the health sector has given rise to the innovation of teledentistry  services that allow remote consultations between dentists and patients. In Indonesia, the use of teledentistry is increasing, especially during the COVID-19 pandemic as an alternative to conventional services. However, the adaptation of these services poses various legal challenges, such as legal certainty over the professional responsibilities of dentists, the protection of patient data, and the validity of online diagnoses. This background encourages the need for in-depth legal studies to ensure that the practice  of teledentistry runs in accordance with applicable laws and regulations and ensures legal protection for all parties involved. This study aims to analyze the legal aspects of health related to the use of teledentistry for dentists in Indonesia. The method used is a normative approach with an analysis of relevant regulations such as Law No. 17 of 2023 concerning Health, the Law on Information and Electronic Transactions, and the Personal Data Protection Law. The results of the study show that although in principle there is no legal prohibition on the practice  of teledentistry, there are still regulatory discrepancies that can cause legal doubts for dentists in carrying out the practice, especially in technical regulations or clear operational guidelines. The conclusion of this study is that specific regulations and comprehensive technical guidelines are needed to regulate the practice  of teledentistry in Indonesia in order to ensure legal certainty for dentists in Indonesia, security of medical information, and quality of service. The suggestion is that the government, through the Ministry of Health and professional organizations, immediately formulate a clear legal and policy framework to support the legal and professional use of teledentistry  technology.
